These Terms of Service ("Terms") govern your use of the iSellForYou website and services. By visiting our site, booking a discovery call, or signing a service agreement with us, you agree to these Terms. If you do not agree, please do not use the site or services.

1. Who we are

iSellForYou is a sales recovery service operated from Executive Bay 901, Dubai, UAE. We provide phone-based recovery for abandoned carts, failed payments, refund requests, and post-purchase upsells on behalf of e-commerce, DTC, and digital-product businesses.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding agreement on behalf of the business you represent. By using our services, you confirm that you meet these requirements.

3. Services and engagement

The specific scope, deliverables, and timelines of any engagement are governed by a separate written service agreement signed by both parties. This page describes general site and pre-engagement terms; the signed agreement controls in case of conflict.

4. Performance-based pricing

Our standard pricing model is performance-based: you pay only on revenue we successfully recover for you. Specific commission percentages, billing cycles, attribution rules, and exceptions are set out in your service agreement. We do not charge setup fees or retainers under our standard model.

5. Your responsibilities

• Provide accurate access to your store, CRM, or checkout system as needed.
• Ensure you have the legal right to share customer contact information with us for the purpose of recovery calls (including consent under applicable telemarketing and data protection laws).
• Pay invoices for recovered revenue in line with the terms of your service agreement.
• Not use our services to contact customers in jurisdictions where doing so would violate law.

6. Our responsibilities

• Use trained closers and reasonable scripts tuned to your brand.
• Record calls for quality assurance (recordings are retained per our Privacy Policy).
• Report results transparently and invoice only for genuinely recovered revenue.
• Treat your customer data confidentially and process it solely to deliver the agreed service.

7. Intellectual property

All content on this website — including text, graphics, logos, and design — is the property of iSellForYou or its licensors and is protected by applicable law. You may not reproduce, distribute, or create derivative works without our prior written consent. Call scripts and playbooks developed for your campaign remain ours, but you receive a perpetual license to use them for your own internal training.

8. Confidentiality

Each party agrees to keep confidential any non-public business information disclosed during the engagement, including customer lists, pricing, sales scripts, and performance data. This obligation survives termination of the engagement.

9. Disclaimers

We provide our services with reasonable skill and care, but we do not guarantee any specific revenue outcome. Results depend on factors outside our control, including your product, audience, and offer. The website and services are provided "as is" without warranties of any kind, express or implied, except as required by law.

10. Limitation of liability

To the maximum extent permitted by law, iSellForYou's total aggregate liability under these Terms or any service agreement shall not exceed the total fees paid by you to us in the three (3) months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of (a) your breach of these Terms, (b) your provision of customer contact data without lawful basis, or (c) your violation of any third-party right.

12. Termination

Either party may terminate an engagement in accordance with the notice provisions in the signed service agreement. Upon termination, we will return or delete your customer data on request, subject to legal retention requirements. Sections 7–11 and 14 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the site or services after changes take effect constitutes acceptance of the updated Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
